Welcome to SpotTheFit (“the Service”), operated by Jake Team LLC(“we,” “us,” or “our”), accessible at spotthefit.ai. By accessing or using the Service, you agree to these Terms of Service. If you do not agree, please do not use the Service.

1. What the Service does

SpotTheFit uses artificial intelligence to identify clothing items and accessories visible in photographs and to suggest similar or matching products available for purchase from third-party retailers, primarily Amazon. Identifications are automated suggestions, not statements of fact — see our Disclaimer.

2. Affiliate relationships

As an Amazon Associate, we earn from qualifying purchases. Links on the Service may be affiliate links: if you click one and make a purchase, we may receive a commission at no additional cost to you. Purchases are made from the third-party retailer under that retailer’s terms — we are not the seller and are not a party to your purchase.

3. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• upload images you do not have the right to use, or images of private individuals without their consent;
• attempt to probe, scrape, overload, reverse engineer, or disrupt the Service or its AI systems;
• use the Service to harass, stalk, or identify private individuals.

4. User content

When you upload a photo for analysis, you represent that you have the necessary rights to it. You retain ownership of content you upload. You grant us a limited license to process your upload (including via third-party AI providers) solely to provide the Service. Uploads submitted for identification are processed and are not published publicly unless you explicitly choose to share them through a feature that offers publication.

5. Intellectual property

The Service’s design, text, and software are owned by Jake Team LLC or its licensors. Third-party content displayed via official platform embeds (e.g., Instagram or YouTube embeds) remains the property of its respective owners and is served by those platforms under their terms. Product names and images are the property of their respective owners.

6. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAKE TEAM LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100.00) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to indemnify and hold harmless Jake Team LLC from claims arising out of your violation of these Terms, including uploading content you lacked rights to use.

8. Changes and termination

We may modify the Service or these Terms at any time; continued use after changes constitutes acceptance. We may suspend or terminate access for violations of these Terms.

9. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to the jurisdiction of those courts.
